REACH UK
Sinds 31 januari 2020 is het Verenigd Koninkrijk (VK) uitgetreden uit de Europese Unie (EU) en is de zogenaamde “Brexit” van kracht gegaan. Indien u chemische producten (inclusief producten in mengsels) verkoopt aan het VK is de REACH UK wetgeving relevant voor u.
Net zoals bij de REACH wetgeving in de EU, moeten alle chemische producten geregistreerd worden in het VK. Deze verplichting ligt bij de Britse importeur van de goederen.
Vóór 28 oktober 2021 dient de Britse importeur een notificatie (preregistratie) te doen. Dit wordt een Downstream User Import Notification (DUIN) genoemd.
Vervolgens moet het product worden geregistreerd. Dit gaat in fases. De registratiedeadline is afhankelijk van of het een CMR (Carcinogeen Mutageen en/of Reprotoxisch) product betreft, en in welke hoeveelheid dit product in het VK wordt geïmporteerd.
Indien een bedrijf minder dan 1.000 kg per jaar van een niet-CMR stof importeert in het VK, is deze uitgezonderd van de REACH-UK verplichting.
In sommige gevallen is het mogelijk dat een producent die niet uit het VK komt, een ‘Only Representative’ in het VK aanstelt om de notificatie en registratie van een product over te nemen.
Vivochem heeft voor alle producten zijn leveranciers gevraagd of zij van plan zijn het product te notificeren en te registreren. Hier wordt door de leveranciers wisselend op gereageerd. U kunt er niet vanuit gaan dat, de producten die u bij Vivochem koopt, automatisch volgens UK Reach geregistreerd zijn, of dat zullen worden.
Indien u onze producten naar het VK exporteert, raden wij u sterk aan te controleren of uw Britse importeur de producten notificeert volgens DUIN, vóór 28 oktober 2021. Meldt u vervolgens de jaarlijkse naar het VK geëxporteerde hoeveelheden per stof bij uw contactpersoon van Vivochem. Samen met uw contactpersoon kunt u vervolgens zoeken naar de beste oplossing voor de continuïteit van onze samenwerking. Meer informatie vindt u op hse.gov.uk/reach. REACH UK
Since January 31, 2020, the United Kingdom (UK) has left the European Union (EU); the Brexit. If you sell chemical products (including products in mixtures) to the UK, the REACH UK legislation is relevant to you.
As with the REACH legislation in the EU, all chemical products must be registered in the UK. This obligation lies with the UK importer of the goods. Before October 28, 2021, the UK importer must make a notification (pre-registration). This is called a Downstream User Import Notification (DUIN).
Next, the product must be registered. This is done in phases. The registration deadline depends on whether the product is a CMR (Carcinogenic Mutagenic and/or Reprotoxic) or in what quantity it is imported into the UK. If a company imports less than 1,000kg per year of a non-CMR substance into the UK, it is exempt from the REACH-UK obligation.
In some cases it is possible for a non-UK manufacturer to appoint an 'Only Reprentative' in the UK to take over the notification and registration of a product.
Vivochem has asked its suppliers for all products whether they intend to notify and register the product. The suppliers have responded differently to this. You cannot assume, that the products you buy from Vivochem are or will be automatically registered according to UK Reach.
If you export our products to the UK, we strongly recommend that you check whether your UK importer is notifying the products according to DUIN before 28 October 2021. Then report to your contact person at Vivochem what the annual quantities per substance to the UK are. Together with your contact person you can then look for the best solution for the continuity of our cooperation.
